Agreement to Terms

By downloading, installing, or using The Herd mobile application (the “App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

Description of Service

The Herd is a photography app that delivers wild horse photos on a weekly basis. The App offers free content (one photo per week) and optional paid subscriptions for additional experiences including live Zoom sessions and physical print deliveries.

Subscriptions

The App offers the following subscription options:

• Monthly Zooms with Tim ($2.99/month): Monthly live Zoom sessions with Tim, plus access to recordings.
• Monthly Prints ($7.99/month): 2 hand-selected 5×7 prints delivered to your door every month, with free worldwide shipping.

Subscription details:

• Payment is processed through our secure checkout at the time of purchase using the payment method you provide.
• Subscriptions automatically renew each month unless canceled before the next billing date.
• You can view and cancel your subscriptions at any time from the Support tab within the App.
• After cancellation, your subscription remains active until the end of the current billing period. You will not be charged again.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Intellectual Property

All photographs, images, and content in the App are the property of Tim West Photography and are protected by copyright law. You may view the photos for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from the content without prior written permission.

User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the App or its systems
• Reproduce, distribute, or share copyrighted content from the App
• Submit false, misleading, or abusive content through the App’s Q&A feature

Account Deletion

You may delete your account at any time through the Profile tab in the App. Account deletion is permanent and cannot be undone. If you have an active subscription, please cancel it from the Support tab before deleting your account to avoid further charges.

Disclaimers

The App is provided “as is” without warranties of any kind. We do not guarantee that the App will be available at all times or that it will be free from errors. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

Limitation of Liability

To the fullest extent permitted by law, Tim West Photography shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.

Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
